The Home Buyer Rescission Period (HBRP) is a mandatory requirement for residential real estate in BC. Below are the most frequently asked technical questions regarding how this law is applied in our local market.

How is the "Three Days" calculated?

The period consists of three business days. The countdown begins at midnight on the first business day after the offer is accepted. Business days exclude Saturdays, Sundays, and statutory holidays. The right to rescind expires at 11:59:59 PM on the third business day.

The 0.25% Rescission Fee

If a buyer chooses to rescind their offer using this right, they must pay the seller a fee equal to 0.25% of the purchase price. This fee is mandatory and cannot be waived by either party.

Note: This fee does not apply if the deal collapses due to a standard subject, such as financing or a home inspection.

Who enforces the payment?

If a brokerage is holding a deposit in trust, the fee is typically paid to the seller directly from those funds. If no deposit is held, the seller must seek payment from the buyer. Disputes regarding unpaid fees are generally directed to the Civil Resolution Tribunal (CRT).

Exemptions to the Rule

The HBRP does not apply to all properties. Specifically, the rescission period does not apply to:

  • Residential properties on leased land.
  • Leasehold interests.
  • Properties sold at auction.
  • Properties sold under a court order or through a foreclosure process.
